In his application in the Latvian Court, Ansar Burney, Advocate has declared the arrest of 10 Pakistanis as illegal and said; this arrest has defamed Pakistan and its nationals and mount to be a discrimination between the human beings on country and religion basis, so he reserves the rights to challenge the same UN and other International levels on defamation charges against Latvia.

Ansar Burney warned if Latvia government failed to release 10 innocent Pakistanis soon he would have no other option except to challenge this illegal arrest and detention in the International Court of Justice, United Nations Human Rights Commission and other International platforms.

"These Pakistanis are innocent Taekwando players who went to Riga to participate in international games on an invitation from Latvia, with legal visas and completing all other legal formalities, but were arrested from their hotel on terrorism charges on a crime they had never committed". Ansar Burney informed the Court.

"Even no weapons or other hazardous materials were found during a search of their hotel." He added.

Burney Trust urges US to allow meeting prisoners in Guantanamo Bay
Sunday December 21, 2003

ISLAMABAD, December 22 (Online): Pakistan's world-renowned human rights activist Ansar Burney, Advocate has reiterated that United States should allow Ansar Burney Welfare Trust International's lawyer team to meet innocent prisoners of circumstances in Guantanamo Bay.

The member of the International Bar Association England and American Bar Association US, Ansar Burney, Advocate in a letter to US Secretary of States and US Ambassador at Islamabad, asked to respect the ruling of the court in the greater interest of Justice and Human Rights and allow 'Ansar Burney Welfare Trust International' team of lawyers and other International human rights NGO's including Amnesty International and Human Rights watch to meet the prisoners confined in US prison.

Meanwhile US appellant court ruled Thursday, Dec 18 that holding about 660 men at the Guantanamo Bay naval base in Cuba without trials runs counter to American ideals.

The federal appeals court in San Francisco said the men have the right to lawyers, as well as trials in US courts.

"Even in times of national emergency - indeed, particularly in such times -it is the obligation of the judicial branch to ensure the preservation of our constitutional values and to prevent the executive branch from running roughshod over the rights of citizens and aliens alike," Judge Stephen Reinhardt wrote for the two-to-one majority.

The ruling contradicts a District of Columbia appeals court ruling, which found the men had no right to be handled through the U.S. legal system.

Meanwhile Ansar Burney also asked the Pakistan's Ministry of Foreign Affairs and Ministry of Interior to contact US government and make arrangements to get permission for the visit of the Ansar Burney Welfare Trust International team consisting on Lawyers to see innocent Pakistani prisoners in Guantanamo Bay cages.

Ansar Burney said that the innocent men, picked up in Pakistan and Afghanistan after the US attack in 2001, have been in legal limbo at the base where they are being held without being even charged.

"In the eyes of law and International charter of the human rights, such arrest and detention has become illegal confinement", human rights Angel Ansar Burney said.

"Even the US government says they are members of either the Taliban, the extremist group that used to rule Afghanistan, or Al-Qaeda, the Islamic militants who allegedly masterminded the attacks against the US on Sept 11, 2001, but they are not proved guilty so far for any terrorism or crime, so their detention since a long has become illegal", he maintained.

"We simply cannot accept the government's position that the executive branch possesses the unchecked authority to imprison indefinitely any persons, foreign citizens included, on territory under the sole jurisdiction and control of the United States without permitting such prisoners recourse of any kind to any judicial forum, or even access to counsel, regardless of the length or manner of their confinement," Judge Reinhardt wrote.

Ansar Burney said that even the children of 15 to 18 years old including one Omar, 16, are confined in US cages without any charge.

The eminent Lawyer, Ansar Burney, in his letters to the Secretary State and US Ambassador in Islamabad, also asked the US, that under what law the US government has detained hundreds of innocent human beings since a long, in the worst cages of Military forces in Guantanamo Bay, to decide their fate.

Ansar Burney, Advocate lauded the ruling of the US Appellate court, and said such act of US is now creating harassment in general public, and mount to be clear violation of the United Nations charter of Human Rights and murder of humanity.

Ansar Burney said that more than 600 innocents, including Pakistanis, Saudi Arabian, Yemenis, Kuwaitis, Iran's, Canadian, British and other nationals and handed them over to United States forces to decide their fate.

He also urges Pakistan government to bring all such prisoners from US custody back to Pakistan and make trial in Pakistan if necessary.

"Are these hundreds innocent prisoners, were not human beings to whom US is treating worst then animals? Ansar Burney further asked with the US.

He urged on US government to treat Pakistanis and other nationals as human beings and not treats innocents as animals or enemies.

"We have no sympathy what so ever with criminals and justice should definitely be done with terrorists and harden criminals, but we will not allow the illegal detention of innocents on the fake name of 'War against Terrorism', he added.
